Welcome to Trekka. These Terms of Service govern your use of the Trekka platform
— including our website, mobile application, and all related services.
By creating an account, making a booking, or using any part of the Trekka platform,
you agree to be bound by these Terms.
Please read them carefully. They explain your rights, your responsibilities,
and the rules that make Trekka safe and fair for everyone — passengers,
transport companies, and drivers alike.
If you do not agree with any part of these Terms, please stop using
the platform immediately. Continued use constitutes acceptance.
Acceptance of Terms
By accessing or using the Trekka platform in any way — whether by browsing, registering an account, making a booking, or using any feature — you confirm that:
- You have read and understood these Terms of Service in full
- You are at least 18 years of age
- You have the legal capacity to enter into a binding agreement
- You agree to comply with all applicable laws in your jurisdiction
- You accept Trekka's Privacy Policy as part of this agreement
These Terms constitute a legally binding agreement between you and Trekka. They are governed by the laws of the Federal Republic of Nigeria Nigerian Law and, where applicable, the laws of the Republic of Ghana Ghanaian Law.
About Trekka — What We Are and What We Are Not
Trekka is a technology platform — a digital intermediary that connects passengers with licensed, independent transport companies for intercity and intrastate travel across Africa.
This distinction is important and you should understand it clearly:
Trekka does not own vehicles, employ drivers, or directly provide transportation services. When you book a trip through Trekka, you are entering into a direct service contract with the transport company operating that trip. Trekka facilitates the booking and payment — it is not the carrier.
Transport companies listed on the Trekka platform are independent operators who have agreed to Trekka's Partner Terms and are responsible for the transportation services they provide. Trekka acts as their technology partner, not their employer or principal.
User Accounts
Eligibility
You must be at least 18 years of age to create a Trekka account and use the platform. By registering, you confirm that you meet this requirement. Trekka does not knowingly allow minors to create accounts. If we become aware that an account belongs to a person under 18, we will terminate it immediately.
Creating Your Account
To access bookings and other platform features, you must register and provide accurate, current, and complete information. You agree to keep your account information up to date at all times.
Account Security & Responsibility
You are solely responsible for:
- Keeping your login credentials — email, password, and any linked authentication — secure and confidential
- All activity and transactions that occur under your account, whether authorised by you or not
- Reporting any suspected unauthorised access, compromise, or suspicious activity to Trekka immediately at security@trekkatravels.com
- Ensuring your contact details remain current so we can reach you regarding your bookings and account
Trekka will never ask for your password via email, phone, or chat. If someone claiming to be Trekka asks for your login details, do not share them and report it to us immediately.
One Account Per User
Each individual may maintain only one passenger account. Creating duplicate accounts to circumvent suspensions, limitations, or platform policies is a violation of these Terms and may result in permanent account termination.
Bookings and Payments
Making a Booking
When you complete a booking on the Trekka platform:
- You enter into a direct transport contract with the transport company operating that trip — Trekka is not a party to that contract
- You agree to pay the total fare displayed at checkout, including any applicable fees
- You confirm that all booking information you provide — passenger names, contact details, seat preferences — is accurate
- You acknowledge that prices and seat availability may change until a booking is confirmed
- A booking is only confirmed upon successful payment processing and issuance of your boarding pass or ticket
Payment Processing
All payments on the Trekka platform are processed securely through our licensed payment partners — Paystack and Flutterwave for transactions within Nigeria and Ghana, and Stripe for applicable international transactions. These providers are independently regulated and PCI-DSS compliant.
By making a payment through Trekka, you agree to:
- Provide valid, accurate payment details belonging to you or for which you have authorisation
- Authorise Trekka to initiate the charge on your behalf through the selected payment method
- Pay all applicable platform fees, taxes, and any charges disclosed at checkout
- Contact your payment provider directly for disputes relating to your card or bank account
Payment Holding & Release
When you pay for a trip, your funds are received by Trekka's payment account and held pending confirmation of trip completion. Upon successful completion of your trip, Trekka releases the transport company's share to their account and retains the applicable platform fee. This process is managed through Trekka's payment infrastructure and our licensed payment partners.
Trekka does not store your card details on its servers. All card and payment information is handled directly by our PCI-DSS certified payment processors.
Cancellations and Refunds
Cancellation and refund terms vary by transport company and may depend on the specific route, vehicle type, and time of cancellation. The following general guidelines apply on the Trekka platform:

Trekka's platform fee is non-refundable in all cases except where a trip is cancelled by the transport company. The transport company's own cancellation policy may apply in addition to these general guidelines. See our full Refund Policy for complete details.
Acceptable Use & User Conduct
Trekka is built to serve travellers, transport companies, and drivers across Africa. To keep the platform safe, fair, and functional for everyone, you agree not to:
- Use the Trekka platform for any illegal, fraudulent, or unauthorised purpose
- Impersonate any person, company, or entity — including Trekka staff or partner companies
- Attempt to access, disrupt, tamper with, or reverse-engineer any part of the Trekka platform, its infrastructure, or its source code
- Submit false, misleading, or inaccurate booking information
- Make fraudulent payment claims, initiate unjustified chargebacks, or attempt to manipulate the payment or refund system
- Harass, threaten, abuse, or discriminate against other users, drivers, or transport company representatives
- Violate the intellectual property rights of Trekka or any third party
- Use automated bots, scrapers, or scripts to access or extract data from the platform without written permission
- Violate any applicable law, regulation, or third-party rights in connection with your use of the platform
Violation of these conduct rules may result in immediate account suspension or permanent termination, at Trekka's sole discretion, without refund of any outstanding bookings. Trekka reserves the right to report illegal activity to the appropriate authorities.
Transport Company Responsibilities
Transport companies listed on the Trekka platform have accepted Trekka's Partner Terms and are independently responsible for the services they provide. As a condition of listing on Trekka, transport companies are required to:
Safety & Compliance
- Maintain valid operating licences in all markets they serve
- Ensure all vehicles are roadworthy, insured, and meet applicable safety standards
- Employ or engage only licensed, trained, and background-checked drivers
- Comply with all applicable transport laws and regulations
Service Standards
- Honour all confirmed bookings made through the Trekka platform
- Notify Trekka and affected passengers promptly of any trip cancellations or changes
- Maintain accurate and current fleet and route information on the platform
- Treat all passengers with dignity and professionalism
Trekka does not guarantee the conduct or service quality of individual transport companies. Trekka's role is to facilitate the connection and booking — the transport company is solely responsible for the delivery of the journey.
Limitation of Liability
Trekka operates as a technology intermediary. Our role is to facilitate the connection between passengers and transport companies — not to provide transport itself. This distinction has important legal implications.
To the fullest extent permitted by applicable law, Trekka is not liable for:
- The quality, safety, reliability, or fitness of any transportation service provided by a transport company
- Any delays, route changes, cancellations, or service interruptions caused by a transport company
- Loss, theft, or damage to personal property during travel
- Personal injury or death arising from the provision of transport services by a third-party operator
- Disputes between passengers and transport companies regarding service delivery
- Loss of data, revenue, or profits arising from platform downtime, technical errors, or service interruptions
- Any indirect, consequential, incidental, or special damages arising from use of the platform
Where Trekka is found liable for any matter directly attributable to its platform services, our total liability to you shall not exceed the total booking amount paid by you for the specific trip to which the claim relates. This cap applies to the fullest extent permitted by Nigerian and Ghanaian law.
Nothing in these Terms excludes or limits Trekka's liability for death or personal injury caused by our own negligence, or for fraud or fraudulent misrepresentation — as these cannot be excluded under applicable law.
Disclaimers
The Trekka platform is provided on an "as is" and "as available" basis. While we invest significantly in building a reliable and secure platform, we make no warranties — express or implied — regarding:
- Uninterrupted, error-free, or continuously available access to the platform
- The accuracy, completeness, or currency of transport company information, pricing, or schedules listed on the platform
- The availability of specific trips, routes, seats, or vehicle types at any given time
- The outcome or quality of any trip booked through the platform
- That the platform will meet your specific requirements or expectations
Trekka will make reasonable efforts to notify users of planned maintenance or service interruptions in advance. However, we cannot guarantee continuous availability and accept no liability for losses arising from temporary platform unavailability.
Intellectual Property
All content on and comprising the Trekka platform — including but not limited to the Trekka name, logo, trademarks, interface design, graphics, text, software, source code, and proprietary processes — is owned by or licensed to Trekka and is protected under applicable intellectual property laws in Nigeria, Ghana, and internationally.
You may not, without Trekka's prior written consent:
- Copy, reproduce, modify, distribute, or create derivative works from any Trekka content
- Use the Trekka name, logo, or any of its trademarks or branding in any commercial or public context
- Reverse-engineer, decompile, disassemble, or attempt to extract the source code of the Trekka platform
- Scrape, harvest, or systematically extract data from the platform for any purpose
- Frame or mirror any part of the Trekka platform on any other website or application
Any unauthorised use of Trekka's intellectual property may constitute an infringement of our rights and will be pursued accordingly.
Privacy
Your use of the Trekka platform is governed by our Privacy Policy, which is incorporated into these Terms of Service by reference and forms part of this agreement.
Our Privacy Policy explains in full what personal data we collect, the lawful basis for each processing activity, how we protect your data, who we share it with, how long we retain it, and what rights you have over your information — including your rights under the NDPA 2023, Ghana DPA 2012, and where applicable, the GDPR.
By using Trekka, you acknowledge that you have read and understood our Privacy Policy.
Account Suspension and Termination
Termination by Trekka
Trekka reserves the right to suspend or permanently terminate your account, with or without prior notice, if you:
- Breach any provision of these Terms of Service
- Engage in fraudulent activity, payment manipulation, or abuse of the refund system
- Harass, threaten, or cause harm to other users, drivers, or transport company representatives
- Use the platform for any illegal purpose
- Create multiple accounts to circumvent a previous suspension or platform limitation
- Provide false identity or contact information during registration or verification
Where a termination is due to your breach, Trekka is not obligated to refund any outstanding bookings. Where a termination is initiated by Trekka without cause, affected bookings will be honoured or refunded in full.
Termination by You
You may delete your Trekka account at any time through your account settings. Upon deletion, your personal data will be handled in accordance with our Privacy Policy and applicable data retention obligations.
Governing Law
These Terms of Service are governed by and construed in accordance with the laws of the Federal Republic of Nigeria. For users in Ghana, applicable provisions of Ghanaian law apply where they are relevant to the user's jurisdiction.
As Trekka expands across additional African markets, the governing law applicable to users in those markets will be specified in a jurisdiction-specific addendum to these Terms.
Dispute Resolution
Trekka believes that most disputes can be resolved fairly and efficiently without going to court. The following process applies to any dispute arising from your use of the Trekka platform:
- Informal Resolution First: Contact Trekka support at support@trekkatravels.com. Most disputes are resolved at this stage within 5–10 business days
- Formal Complaint: If informal resolution fails, submit a formal written complaint to legal@trekkatravels.com. Trekka will respond within 14 business days with a formal position
- Mediation: If the dispute remains unresolved, both parties agree to attempt resolution through an independent mediator before pursuing legal action. The cost of mediation will be shared equally unless otherwise agreed
- Arbitration or Litigation: Where mediation fails, disputes shall be resolved through binding arbitration or through the competent courts of Nigeria, depending on the nature and value of the claim
For disputes between passengers and transport companies regarding service delivery — delays, cancellations, damage to property — Trekka will provide reasonable facilitation and mediation support, though Trekka is not a party to the transport contract and cannot be held liable for the transport company's conduct.
Changes to These Terms
Trekka may update these Terms of Service from time to time to reflect changes in our services, applicable law, or platform policies. When material changes are made, we will:
- Post the updated Terms on this page with a revised "Last Updated" date
- Notify registered users via email at least 14 days before the changes take effect, where the changes are material
- Display a prominent notice on the platform for a reasonable period following any significant update
Your continued use of the Trekka platform after the effective date of any updated Terms constitutes your acceptance of the revised Terms. If you do not agree with the changes, you may delete your account before the effective date.
